education.au limited's PRIVACY STATEMENT

  1. Introduction
    In Australia, collection and handling of personal information is regulated by the Privacy Act 1988. Personal information is basically information or an opinion which can identify you.
    education.au limited believes that privacy is an important individual right and understands that privacy is important to you. The purpose of this Privacy Statement is to explain how we may collect personal information about you, and how we might use, disclose and handle that personal information.
  2. Collection of personal information
    Established in 1997, education.au limited is a national ICT agency for education and training, owned by the Commonwealth and State and Territory education and training Ministers. education.au limited collaborates with numerous stakeholders in education and training communities to develop and manage online services that are of benefit to the education and training sector and are national in scope.
    education.au limited only collects personal information if it is necessary for our business purposes. The information we collect will depend on the purpose for which it is collected - it may include:
    personal information collected from participants of our programs and projects and recipients of our services;
    personal information collected from business contacts; and
    personal information collected from our employees and contractors.
    We will not collect sensitive information about you (such as details of your race, political beliefs, religion or health) without your consent.
  3. How we use your personal information
    We generally use your personal information for the purpose for which it is collected, except as outlined in this section.
    The personal information collected by education.au limited is used:
    · to provide the participants of our programs or projects with information about those programs or projects and the recipients of our services with such services and to notify those participants and recipients about existing or new education.au limited programs, projects, services or promotions from time to time;
    · for responding to an individual's request; and
    · for other business purposes including the establishment of programs, projects and initiatives to further our business and the performance of our contractual obligations.
    We may use personal information for business purposes which are closely related to the primary purpose of collection. We may also use contact information to market our related services, however, you will always be given the opportunity to elect not to receive further marketing information from us. If at any time you no longer wish to be notified about new education.au limited products, services or promotions, please inform our privacy access officer, who can be contacted by writing to the address set out below.
    We will not collect or use personal information in ways other than as stated in this policy unless we have obtained an individual's consent. In some cases we may specifically request a consent form to be signed. In other cases, consent may be implied (e.g. where an individual gives us information after being fully advised of how it will be used).
  4. How we disclose your personal information
    In the circumstances described below, personal information may be disclosed outside education.au limited.
    (a) Contracting
    Personal information collected by us may be disclosed to third parties with whom we contract. If we do disclose personal information to third parties under outsourcing or contracting arrangements for example, we take steps to ensure that those third parties:
    · comply with the National Privacy Principles as contained in the Privacy Act when they handle your personal information, and
    · are authorised only to use personal information in order to provide the services or to perform the functions required by us.
    (b) Disclosures required by law
    For legal reasons, other disclosures may need to be made to law enforcement agencies, government agencies, courts or external advisors or in accordance with other laws.
    We do not sell, rent or trade personal information to or with third parties.
  5. Privacy on our websites
    This policy applies equally to any personal information we collect via our websites, including the sites at www.educationau.edu.au, www.edna.edu.au, www.myfuture.com.au, www.thelearningfederation.edu.au, www.education.gov.au, and www.domainname.edu.au. Apart from personal information you provide to us intentionally (e.g. where you make a request or complete a registration form), this section explains some other ways in which education.au limited collects information via its websites.
    When you visit our websites our server makes a record of your visit and logs the following personal information:
    · your server address;
    · your top level domain name (eg .com, .gov, .au, .net, .edu, etc.);
    · the time and date of your visit to the website;
    · the pages and documents you have accessed or viewed; and
    · the type of browser you are using.
    Cookies may be used on some areas of our websites. A cookie is a small amount of information stored on your computer by a server. This information is sent by your browser to a server whenever you visit that server again. Cookies are used to remember your browser between page visits. The cookie identifies your browser and not you personally.
    If you are concerned about cookies, most browsers now recognise when a cookie is offered and permit you to opt out of receiving it. If you are not sure whether your browser has this capability, you should check with the software manufacturer or your internet service provider. In most cases, you can refuse a cookie and still fully navigate education.au limited's websites.
    The personal information collected by education.au limited when you send us an email, when you post a submission to a forum, chat or discussion list, or when you upload a document may include your email address and may also include some of your personal information.
    We will only publish personal information on our websites if it has been collected for this purpose with your knowledge, or if you have otherwise consented to the disclosure. When giving such consent you should be aware that personal information published on our websites are accessible by multiple users from all over the world, that it will be indexed by search engines and that it may be copied and used by any web user. This means that once the personal information is published on the website, we will have no control over its subsequent use and disclosure.
    Our websites do not provide facilities for the secure transmission of information across the internet. You should be aware that there are inherent risks associated with the transmission of personal information via the internet. We provide a number of links to websites operated by third parties. You should be aware that we are not responsible for the privacy practices or policies of those sites. We encourage you to review each website's privacy policy, especially if you intend to disclose any personal information via that site.
  6. Security of your personal information
    We take all reasonable steps to ensure that the information (including personal information) we hold is not subject to loss, misuse or unauthorised access or alteration. Our IT systems are password protected and comply with our security standards, and if personal information is held on paper files, it is stored in locked compactuses. We only permit your details to be accessed by authorised personnel.
  7. Access to your personal information
    In most cases, the Privacy Act gives you the right to gain access to personal information that we hold about you. All requests for access to your personal information will be handled by our privacy access officer, who can be contacted by writing to the address set out below.
    We will deal with all requests for access to personal information as quickly as possible. Requests for a large amount of information, or information which is not currently in use, may require further time before a response can be given. Please note that we are entitled to charge you the reasonable costs which we incur in complying with such a request for access.
    In some cases, consistently with the Privacy Act, we may refuse to give you access to personal information we hold about you. This includes circumstances where giving you access:
    · would have an unreasonable impact on other people's privacy;
    · would prejudice negotiations we are having with you;
    · would prejudice an investigation of unlawful activity; or
    · would prejudice activities carried out by, or for, a law enforcement agency.
    If we refuse to give you access we will provide you with reasons for our refusal.
  8. Corrections
    Generally, if you request us to do so we will amend any personal information about you held by us which is inaccurate, incomplete or out of date. If we disagree with you about the accuracy, completeness or currency of a record of your personal information held by us, we will take reasonable steps to associate with that record a statement to the effect that you claim this to be the case, if you request us to do so.

    In some circumstances we develop further principles in relation to the collection of data for purposes related to specific activities of education.au limited. In these circumstances users are referred to separate documents containing such principles. This Privacy Statement may be modified or supplemented by such documents. The particular document will state whether it applies subject to this Privacy Statement or whether it overrides provisions of this Privacy Statement.

ADDITIONAL PRINCIPLES APPLICABLE TO .EDU.AU DOMAIN NAME REGISTRANTS

Section 10 of education.au limited’s privacy policy states that in some circumstances education.au may develop further principles in relation to the collection of data for specific activities of education.au limited.

The following principles apply to all registrants (and applicants) of edu.au domain names. These principles apply in addition to education.au limited’s general privacy policy, and override the provisions of that privacy policy if there is any inconsistency between the two documents.

While education.au limited understands that privacy is important to you, registration of an edu.au domain name is a relatively open and public process. It is therefore important that you read the following principles and understand the ways in which your personal information may be used and disclosed to third parties.

  1. Collection of personal information
    When you apply for an edu.au domain name, we collect the personal information you provide to us on the registration form. We also collect personal information you may submit to us in managing your edu.au domain name (such as updated contact details) and when you renew your edu.au domain name. This information is termed your “registration information” for the purposes of these principles.
    We may also collect other personal information when you deal with us in relation to your domain name, such as if a dispute arises in relation to the use of your domain name.
  2. Use of information
    We use the personal information that you provide to us for administering the edu.au domain name space. We store some or all of this information in an electronic management system, so that we can record the history of our dealings with you. We also store your registration information in a central database maintained by education.au limited of all registrants of edu.au domain names.
  3. Disclosure of personal information
    The registration information that you provide to us is disclosed by education.au to AusRegistry, a third party who are responsible for maintaining a comprehensive database of all domain name registrants in the .au domain name space.
    Your registration information stored in both the education.au limited and AusRegistry databases is publicly searchable and accessible, via the internet, by any third parties who choose to do so. education.au limited has no control over the way in which any such third parties may use your personal information. We may also disclose your personal information to the Education Domain Name Administration Committee (eDAC). This may include for the purposes of enabling eDAC to consider whether your application for an edu.au domain name complies with the registration criteria, and also in considering any dispute over your right to register an edu.au domain name.
    We also prepare summary reports of our dealings with registrants from our electronic management system, and provide copies of these reports to eDAC. Such reports may include your personal information.
